The Ondo State High Court, Okitipupa, granted an interim injunction on October 23, 2025, restraining any further selection or election process for the Olofun of Irele Chieftaincy stool.
The order, issued by Hon. Justice A.W Fabuluje follows a motion ex-parte by claimants, pending hearing on Nov 5, 2025.
A 48-paragraph affidavit filed by High Chief Adetowo Olowogbemi on Oct 22, 2025 urged the court to halt proceedings by defendants (1st–5th), privies, staff, nominees, amid an ongoing suit.
According tho the order, “No new process until resolution, the Pursuant to Order 20 Rules 1–3, Ondo State High Court (Civil Procedure) Rules 2019, and the court’s inherent jurisdiction, Justice Fabuluje struck out a withdrawn leave application, granting the restraint ex-parte for urgency.
"Defendants, privies, servants cease all actions on the Olofun stool, pending hearing, the injunction mandates, Claimants must serve the order and motion on defendants by Nov 5, 2025, for full hearing.
"And for Such Further and other Orders as this Honourable Court may deem fit to make in the circumstances of this case.
"It Is Hereby Certify that motion Ex-parte came up before His Londship; Hon. Justice A.W Fabuluje-Judge of Ondo State High Court on the 23rd day of October, 2025.
"Upon reading the motion Ex-Parte and 48 paragraph Affidavit in. support, sworn to by one HIGH CHIEF Adetuwo Olowogbemi, male, Christian, Adult, Farmer of No 8, Opetusin street, Ode-irele in irele Local Government Area, Ondo state and filed at the High Court Registry, Okitipupa on the 22™ day of October 2025.
"And the court after listening to Prince J.0 Famakin Esq, Counsel to the Claimants/Applicants and the Court ordered as follows:
"Application Exparte for leave to bring application for interim and interlocutory having been withdrawn is hereby struck out while the Exparte to restrain the pondents dated and filed the urgency is hereby granted Court hereby direct that the order and the motion on noticed be served on the defendants/Respondent, Case adjourn to 05/11/2025 for the hearing of the motion on notice
