Justice Olusegun Odusola, of an Akure High Court yesterday refused to grant the bail application of the Sotitobire Praising Chapel church prophet, Alfa Babatunde and the six other defendants that were facing trial along with him.
While delivering the ruling, the judge held that the bail applications were refused due to the fact that the grounds for their bail application were not in accordance with the law.
It would be recalled that on the June 24, 2020, the court had received an application for bail and thereafter fixed July 30 for the ruling on the bail application brought by the lead Counsel to the prophet, Olusola Oke, on health grounds.
Akinyemi Omoware, lawyer representing other defendants, also moved an application for the bail of the other church workers.
The prosecution counsel, led by Bola Ogundadegbe of the Ministry of Justice, however, opposed the applications before the court.
In her counter-affidavits, Ogundadegbe argued that there was no evidence before the court to prove the health status of Babatunde and the other defendants in the case as claimed by the defence counsel.
Justice Olusegun Odusola had adjourned ruling on the application till July 30, 2020 and eventually delivered the ruling yesterday, August 6, 2020.
In an earlier ruling, the court had also unfrozen Prophet Babatunde’s bank account following an application that was also moved by his lawyer.
